Petit Larceny charge

The New York State Penal Code divides Larceny into two categories, Petit, (also known as “Petty”) and Grand Larceny. A Petit Larceny charge according to article 165, of the New York Penal Code, states, a person is guilty of petit larceny when he steals property. A Petit Larceny charge is classified as a class-A misdemeanor, in which the value of the property does not exceed $1000. Class-A misdemeanors for Petit Larceny can carry a minimal sentence of conditional discharge, to a maximum sentence of up to 12 months in jail. Individuals convicted of Class A misdemeanors may also be sentenced to community service, probation or part-time incarceration. Additionally, misdemeanors may result in the loss of professional licenses, employment or loss of public office.

Grand Larceny charge

Grand Larceny is considered to be a more serious crime than Petit larceny, as it involves a felony sentence and the use of “degrees” to distinguish the severity of the felony charge. For example; Grand larceny in the First degree is considered to be a Class B Felony in which a person is guilty of stealing property which exceeds one million dollars. A 1st degree Grand Larceny charge can carry a minimum of 1 to 25 years in jail. By contrast, a charge of Grand larceny in the Fourth Degree, for property theft above $1000 or more, includes a Class E Felony sentence, which is punishable by a minimum of one year, up to four year jail term.
